Welcome to Lucruapp.com (the “Platform”), operated by Lucru (“we,” “our,” or “us”), a business currently in the process of incorporating in Ontario, Canada.
These Terms of Service (“Terms”) govern your access to and use of the Platform.
1. Acceptance of Terms
By accessing or using Lucruapp.com, creating an account, or using any services offered through the Platform, you agree to be bound by these Terms.
If you do not agree, you may not use the Platform.
We may update these Terms from time to time. Continued use of the Platform after changes become effective constitutes acceptance of the revised Terms.
2. What Lucru Provides
Lucru is a marketplace platform that connects:
- Service Providers (individuals offering professional or skilled services), and
- Clients (individuals or businesses seeking services)
Lucru facilitates discovery, communication, booking, and payment tools, but does not directly provide the services offered by Providers.
3. Independent Contractor Relationship
Service Providers on Lucru are independent contractors, not employees, agents, partners, or representatives of Lucru.
Lucru does not control or direct how Providers perform their services.
Providers are solely responsible for:
- Service quality and delivery
- Licenses, permits, and legal compliance
- Insurance coverage
- Reporting and paying all applicable taxes
4. Eligibility
You must be at least 18 years old to use the Platform.
By using Lucru, you represent and warrant that you meet this requirement.
5. User Accounts and Security
To access certain features, you may need to create an account.
You agree to:
- Provide accurate and complete information
- Maintain the confidentiality of your login credentials
- Be responsible for all activity under your account
Notify us immediately of any unauthorized use or suspected breach.
6. Acceptable Use
You agree not to use the Platform to:
- Upload or distribute malware or harmful code
- Engage in unlawful, fraudulent, abusive, or discriminatory conduct
- Harass, threaten, or defame others
- Infringe intellectual property rights
- Attempt unauthorized access to accounts or systems
- Disrupt or interfere with Platform security or functionality
We may suspend or terminate access for violations.
7. Marketplace Bookings and Responsibility
Clients and Providers are solely responsible for:
- Agreeing to service terms and expectations
- Completing services safely and legally
- Resolving disputes directly
Lucru is not responsible for the outcome, quality, safety, or legality of services provided through the Platform.
8. Payments and Stripe Processing
Payments on Lucru are processed through third-party providers such as Stripe.
Lucru does not store full credit card details.
By using payment features, you agree to comply with Stripe’s terms and policies.
Lucru may charge platform or processing fees, which will be disclosed before any transaction is completed.
9. Reviews and User Content
Users may post reviews, ratings, profile content, and service listings (“User Content”).
You retain ownership of your User Content but grant Lucru a worldwide, non-exclusive, royalty-free license to use, display, and distribute it for Platform operation and improvement.
You agree not to post content that is false, abusive, unlawful, or misleading.
10. Intellectual Property
All Platform content (excluding User Content), including branding, design, and software, is owned by Lucru and protected by intellectual property laws.
You may not copy, reproduce, modify, or exploit any part of the Platform without written permission.
11. Suspension and Termination
We may suspend or terminate your access if you:
- Violate these Terms
- Engage in fraud or misuse
- Create legal or safety risk for other users or Lucru
Upon termination, your right to use the Platform ends immediately.
12. Disclaimer of Warranties
The Platform is provided “as is” and “as available.”
Lucru makes no warranties that:
- The Platform will be uninterrupted or error-free
- Services will meet expectations
- Providers or Clients will perform satisfactorily
Use of the Platform is at your own risk.
13. Limitation of Liability
To the maximum extent permitted by law, Lucru shall not be liable for any indirect, incidental, special, consequential, or punitive damages.
Lucru’s total liability for any claim shall not exceed the amount paid by you to Lucru in the twelve (12) months preceding the claim.
14. Indemnification
You agree to indemnify and hold harmless Lucru from claims, damages, liabilities, and expenses arising from:
- Your use of the Platform
- Your services or bookings
- Your violation of these Terms
- Your User Content
15. Privacy
Your use of the Platform is also governed by our Privacy Policy, which explains how we collect and use personal information.
16. Governing Law (Ontario, Canada)
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein.
Any disputes shall be resolved exclusively in the courts located in Ontario, Canada.
